1. Who we are

These Terms of Service ("Terms") form a legally binding contract between you ("Customer", "you") and:

(referred to in these Terms as "Safepool", "we", "us" or "our").

We operate the online store at safepool.store and provide the information, content, features, products and services available through it (the "Services"). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

2. Eligibility

You must be at least 18 years old, or the age of legal capacity in your country of residence, to place an order. By using the Services, you confirm that you have the legal capacity to enter into this contract.

3. Products and prices

We sell pool covers, robots, filters, replacement cartridges, heat pumps, salt chlorinators and related accessories. Product descriptions, images and specifications are provided as accurately as possible, but minor variations may occur.

All prices on safepool.store are shown in euros (€) and include applicable Spanish VAT (IVA), unless otherwise stated. We reserve the right to change prices at any time, but changes will not affect orders that have already been confirmed.

Shipping costs are calculated at checkout based on your destination and are shown before you confirm your order.

Where we sell to B2B customers in another EU country with a valid VAT number, we may issue invoices under the EU reverse-charge mechanism (0% VAT). Please contact us before placing the order if this applies to you.

4. How a contract is formed

The display of products on safepool.store is an invitation to treat, not a binding offer.

A contract between you and Safepool is formed when you place an order through the checkout and we send you an order confirmation email accepting that order.

We may decline or cancel an order before dispatch if:

  • the product is unexpectedly out of stock,
  • a pricing or description error is identified,
  • we suspect fraud or unauthorised use,
  • delivery to your address is not possible.

If we cancel an order before dispatch, we will refund any amounts already paid in full.

5. Payment

We accept the following payment methods through Shopify Payments and other PCI-compliant providers: Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay, PayPal, Klarna and Bancontact.

Payment is taken when you place your order. We do not store full payment card details — these are handled by our payment processors.

6. Shipping and delivery

Standard delivery takes 7–15 working days across mainland Spain and most of Europe, depending on destination and product availability. Shipping is performed by authorised couriers selected by us.

Risk in the goods passes to you when the goods are delivered to the address you provided, or to the nearest available service point if you have authorised collection there.

7. Right of withdrawal and returns

If you are a consumer resident in the EU, you have a statutory right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason.

In addition, we voluntarily offer a 30-day return window for unused products in resalable condition with original packaging intact.

Custom-built products (such as automatic pool covers manufactured to your pool's specific dimensions) cannot be returned for reasons other than defects, as they are made to your specification (Art. 103.c RDL 1/2007).

8. Warranty and consumer rights

All goods sold come with the statutory 3-year conformity guarantee for hidden defects under Spanish consumer law (Real Decreto Legislativo 1/2007, Arts. 114 et seq., as amended by Law 7/2021). Many products also come with an additional manufacturer warranty (typically 2 years; 3 years for our automatic pool covers).

Nothing in these Terms limits or excludes your statutory rights as a consumer.

9. Customer accounts

You are responsible for keeping your account credentials confidential and for all activities that occur under your account. Notify us immediately at info@safepool.es if you suspect any unauthorised use of your account.

We may suspend or close accounts that violate these Terms, including accounts used for fraud or unlawful activity.

10. Acceptable use

You agree not to use the Services:

  • for any unlawful purpose or in violation of any applicable law or regulation;
  • to harm, harass, defraud, or impersonate any other person or entity;
  • to interfere with the security or operation of the Services, including by uploading malicious code, attempting to gain unauthorised access, or scraping content at scale;
  • to infringe any intellectual property rights;
  • to post false, misleading, or defamatory content (including fake reviews).

We reserve the right to restrict or remove access for breach of these rules.

11. Intellectual property

All content on safepool.store — including text, photographs, graphics, logos, the "Safepool" name and trade dress — is owned by Safe Smart Pool, S.L. or our licensors and is protected by Spanish, EU and international intellectual property laws.

You may view and download content for personal, non-commercial use only. Any other use, including reproduction, modification, distribution, public display or use for commercial purposes, requires our prior written consent.

12. Liability

We are liable to you for foreseeable loss and damage caused by our breach of these Terms or by our failure to use reasonable care and skill, in line with applicable Spanish and EU consumer law.

To the maximum extent permitted by law, we are not liable for:

  • indirect, incidental, special or consequential losses;
  • loss of profits, business, opportunity, goodwill or data;
  • losses arising from circumstances outside our reasonable control (force majeure — see clause 13);
  • damages caused by misuse of products, failure to follow installation or operating instructions, or installation by unqualified persons, except where our statutory obligations to consumers require otherwise.

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • any other liability that cannot be limited or excluded under applicable law (including our statutory obligations to consumers under RDL 1/2007).

For any single transaction, our total liability to you is limited to the price you paid for the product giving rise to the claim, except where applicable law requires otherwise.

13. Force majeure

We are not in breach of these Terms or liable for any failure or delay caused by events beyond our reasonable control, including acts of God, fire, flood, severe weather, pandemic, strike, war, civil unrest, courier strikes, customs holds outside Spain, government action, or failures of telecommunications or energy networks. We will notify you as soon as reasonably possible if such an event affects your order.

14. Privacy and cookies

Your privacy is important to us. The way we collect, use and protect your personal information — including our use of cookies and similar technologies — is described in our Privacy Policy.

15. Modifications to these Terms

We may update these Terms from time to time, for example to reflect changes in our products, in applicable law, or in how the Services operate. The updated version will be posted on this page with a new "Last updated" date.

The Terms in force at the time you place an order govern that purchase.

16. Governing law and jurisdiction

These Terms are governed by Spanish law. For non-consumer customers (B2B), any disputes arising from the use of the Services or the purchase of products will be resolved by the courts of Málaga, Spain.

Consumers resident in another EU country retain the right to bring proceedings in the courts of their country of residence and to rely on the mandatory consumer protection rules of that country, as required by EU law.

17. Online dispute resolution

As an online seller in the EU, we are required to inform you of the European Commission's Online Dispute Resolution (ODR) platform, available at:

If you have a complaint, we encourage you to contact us first at info@safepool.es so we can try to resolve it directly.

18. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be deemed severed and the remaining provisions will continue in full force and effect.

19. Entire agreement

These Terms, together with our Privacy Policy, Shipping Policy and Return & Refund Policy, constitute the entire agreement between you and Safepool relating to your use of the Services.
